AM REALTY | Real Estate Media Services

Effective Date: September 1, 2025

These Terms of Service (“Agreement”) govern the provision of real estate media services (“Services”) by [Your Business Name] (“Provider,” “we,” or “us”) to clients (“Client,” “you”). By booking or using our Services, you agree to these Terms.

1. Services Provided

• Professional Photography (Interior & Exterior)
• Photography Add-ons (must be ordered in conjunction with a Professional Photography service.).
• 3D Virtual Tours
• 2D Floor Plans
• Aerial Photography & Video (FAA-compliant)
• Virtual Staging (Up to 3 rooms, must be vacant)
• Social Media Marketing Videos

2. Scheduling & Timeframes

Booking: Services must be scheduled at least 48 hours in advance. Same-day requests are subject to availability and may incur a rush fee.

Next-Day Appointments: Next-day services may be available if booked by 6 pm the evening prior, subject to the Provider’s availability and approval.

Site Entry: For safety and security, the realtor or a designated representative must be present to allow AM Realty team member entry into the space.

On-Site Duration: Typical on-site sessions last between 1–4 hours, depending on property size and services booked.

Delivery Timeline:

• Photography: 2 business days
• 3D Virtual Tours: 3–4 business days
• 2D Floor Plans: 2–3 business days
• Aerial Media: 2–3 business days (weather permitting)
• Virtual Staging: 4–5 business days
• Social Media Videos: 5–7 business days

Rush Delivery: Available upon request for an additional fee.

3. Client Responsibilities

• Ensure the property is clean, staged, and photo-ready prior to the scheduled appointment.
• Grant access to the property at the agreed time. Missed or delayed access may result in rescheduling fees.
• For aerial services, the Client must confirm there are no legal or HOA restrictions preventing drone flights in the area.

4. Payment Terms

• Payment is due at the time of booking, unless otherwise agreed in writing.
• Accepted forms of payment: credit card, ACH transfer, or approved invoicing.
• Unpaid balances may delay delivery of final media.

5. Cancellation & Rescheduling

• Cancellations with 24+ hours’ notice: No fee.
• Cancellations within 24 hours: Subject to a $100 fee.
• Rescheduling: One complimentary reschedule is allowed if notified at least 24 hours in advance.
• Weather-related delays for aerial/drone services will be rescheduled at no additional cost.

6. Intellectual Property & Usage Rights

• Provider retains copyright ownership of all media.
• Clients receive a non-exclusive, royalty-free license to use media for real estate marketing, including MLS listings, websites, and social media.
• Media may not be resold, transferred, or used for purposes outside of property marketing without prior written consent.

7. Liability & Limitations

• We are not liable for property condition, staging, or items visible in photos/videos. Client assumes responsibility for presentation.
• For aerial/drone services, Provider complies with FAA Part 107 regulations. Flights are subject to weather, airspace restrictions, and safety considerations.
• Provider is not responsible for delays caused by circumstances beyond our control (e.g., weather, equipment failure, access issues).
• In no event shall Provider’s liability exceed the total fees paid by the Client for the Services.

8. Revisions & Corrections

• Minor edits (color correction, exposure, cropping) are included.
• Major revisions or re-shoots requested by the Client may incur additional fees.

9. Governing Law

This Agreement is governed by the laws of the state of Georgia and disputes shall be resolved in courts located in the State.

10. Acceptance

By booking or using our Services, you acknowledge that you have read, understood, and agree to these Terms of Service.
